Darlo Higher Education is a trading name of Darlo Group Pty Ltd (Australia, ABN 77 151 201 526). The policy below applies to all services delivered under this name.

Refund Policy

1. Overview

This Refund Policy applies to consulting services provided by Darlo Group Pty Ltd (ABN 77 151 201 526) under the trading name Darlo Higher Education.

2. Free Initial Consultations

Initial consultations are offered free of charge and create no payment obligation. Nothing in this policy applies to free consultations.

3. Paid Engagements

Refunds for paid engagements are governed by the engagement-specific written agreement (such as an engagement letter, proposal, or scope-of-work document) executed between us and you. Where the engagement-specific agreement is silent on refunds, the principles in this policy apply.

4. When Refunds Are Available

We may issue a refund (in whole or in part) where:

  • We have failed to deliver the agreed service through our fault, and the failure cannot be remedied within a reasonable time.
  • The engagement is cancelled by us (other than for your material breach), in which case we will refund any fees paid in advance for work not yet performed.
  • The Australian Consumer Law (see clause 6) requires us to provide a refund.

5. When Refunds Are Not Available

Refunds are generally not available where:

  • The engagement has been delivered in accordance with the agreed scope.
  • You cancel after work has been performed, in which case fees for work performed up to the cancellation date are payable.
  • Failure to achieve a specific outcome (such as a TEQSA approval decision) was driven by factors outside our control. Consulting engagements are services-based; we do not guarantee specific regulatory or commercial outcomes.

6. Australian Consumer Law

Nothing in this Policy excludes, restricts or modifies your rights under the Australian Consumer Law. Our services come with consumer guarantees that cannot be excluded, including a guarantee that services will be supplied with due care and skill and will be reasonably fit for any specified purpose. If a service does not meet a consumer guarantee, you may be entitled to a refund, replacement, or compensation under that law.

7. How to Request a Refund

To request a refund, contact us in writing at info@darlo.com. Please include the engagement reference (or the date and nature of the engagement), the reason for the request, and any supporting information. We will respond within ten (10) business days.

Approved refunds are returned to the original payment method within fourteen (14) business days of approval.

8. Disputes

We aim to resolve refund requests cooperatively. If a dispute cannot be resolved between us, you may seek mediation through Consumer Affairs Victoria or the equivalent body in your state or territory.
